Mediation and Family Dispute Resolution
Family Dispute Resolution (FDR) is a specialised type of family mediation where an indpependnt professional helps seperating couples make practical agreements about parenting arragements and property division. In Australia, attempting FDR is generally mandatory before filing a court application for parenting orders.
How FDR Works
- Impartial Practitioner: A trained Family Dispute Resolution Practitioner (FDRP) guides discussions neutrally without deciding who is right.
- Assessment: The practitioner screens cases first to check if they are safe and suitable for mediation.
- Flexible Formats: Sessions can happen face-to-face, online, or via “shuttle mediation” where parties sit in separate rooms.
- Confidentiality: Conversations are private and generally cannot be used as evidence in a court hearing.
Common Issues Addressed
- Parenting Plans: Where children live, how much time they spend with each parent, schooling, and health care.
- Financial and Property Matters: Splitting shared assets, bank accounts, or debts.
- Communication Strategies: Improving how parents talk and manage future conflict
